These Terms of Use (the “Terms”) apply to use of the website https://www.bestishome.com/ (the “Site”), operated by Shenzhen Youmijia Technology Co., Ltd. (the “Company”) for its brand “Bestis”. By using the Site, a user is deemed to have agreed to the Terms.

The terms used in the Terms have the meanings set out below.

1. “the Service” means the sale of goods, and related services, provided through the Site.

2. “user” means any person who views or uses the Site.

3. “member” means a user who has registered an account on the Site.

4. “goods” means the products the Company sells on the Site.

1. A person wishing to register as a member shall agree to the Terms and register by the method the Company specifies.

2. The Company may decline to approve a registration where the applicant falls under any of the following.

(1) They have provided false information.

(2) They have previously breached the Terms.

(3) The Company otherwise judges the registration to be inappropriate.

1. Members shall manage their own account information (ID, password and the like) appropriately, and shall not allow a third party to use it.

2. The Company is not liable for loss arising from unauthorised use of an account.

Users shall not do any of the following when using the Site.

1. Acts that violate laws and regulations, or public order and morals.

2. Acts that infringe the rights of the Company or a third party, including intellectual property rights such as copyright and trademark rights.

3. Gaining unauthorised access to the Site’s systems, or destroying or altering them.

4. Entering false order information.

5. Any other act the Company judges to be inappropriate.

1. A user may purchase goods by selecting the goods they want on the Site and completing the specified order procedure.

2. An order is concluded at the point the Company accepts it. Depending on stock, the Company may be unable to accept an order.

3. Prices, specifications and the like may change without notice.

1. The price of the goods shall be paid by the payment method specified at the time of the order.

2. The available payment methods are as follows.

3. Where payment cannot be confirmed, the Company may cancel the order.

1. Goods are delivered within 2 to 5 days of the order being confirmed.

2. Delivery is available within Japan only.

3. Delivery is free of charge on purchases of ¥9,999 (tax included) or more.

4. Delivery may take longer because of weather, traffic conditions and the like.

1. A request to return or exchange goods shall be made within 8 days of the goods arriving.

2. The Company accepts returns and exchanges in the following cases.

(1) Initial defects (damage or a fault present on arrival).

(2) Damage in transit.

(3) Goods delivered that differ from the order.

3. Returns for the customer’s own reasons are accepted only where the goods are unused and unopened. In that case the customer bears the postage both ways.

4. The Company may decline a return or exchange in the following cases.

(1) More than 8 days have passed since the goods arrived.

(2) The goods were damaged through the customer’s own fault.

(3) There is scratching or soiling that arose after assembly.

5. A refund following a return is made within 5 business days of the returned goods arriving and being checked.

All intellectual property rights in the text, images, design, logos and other material on the Site belong to the Company or to the rightful owner. Users shall not reproduce, republish or alter them without the Company’s prior consent.

1. The Company does not warrant the accuracy, the safety, or the fitness for a particular purpose of the Site or the goods.

2. The Company is not liable for loss suffered by a user through use of the Service, except where it is caused by the Company’s wilful misconduct or gross negligence.

3. The Company is not liable where order data is lost through a communications fault or the like. This does not apply where the Company is guilty of wilful misconduct or gross negligence.

The Company may change the content of the Site, or suspend provision of the Service, without prior notice. The Company is not liable for loss suffered by a user as a result.

Where a user has breached the Terms, or where the Company judges that there is a risk they will, the Company may restrict that user’s use of the Site or cancel their membership without prior notice.

The Company may change the Terms where it judges it necessary to do so. The revised Terms take effect when they are posted on the Site.

The Company handles users’ personal information appropriately, in accordance with its Privacy Policy.

1. The Terms are governed by the laws of Japan and construed in accordance with them.

2. The Tokyo District Court shall have exclusive jurisdiction in the first instance over any dispute relating to the Terms.
